Holiday sickness tourists settle

In news which will interest those searching for travel insurance, a group of 292 holidaymakers have settled their damages claims over bouts of gastric illness they suffered during holidays in the Dominican Republic.

The claimants, including 39 children, had brought High Court proceedings against tour operators Thomas Cook Tour Operations Ltd and TUI UK Ltd.

They had all become ill during all-inclusive package holidays at a hotel complex in Bahia Maimon near Puerto Plata between November 2005 and September 2006.

Counsel Matthew Chapman told Mrs Justice Thirlwall in London that the main bone of contention in the action, which was scheduled for a 10-day trial, was whether the illness was caused by a virus or a food- or drink-borne infection.

He revealed that nine claimants had settled their case against Thomas Cook a year ago while the other 283 had now reached agreement with TUI UK on confidential terms.

The settlement was approved by the judge.
