September Engagement Competition T&Cs

1. Who can Enter
1.1. To be eligible to enter the Competition entrants will need to be an esure customer with an existing esure Motor, Multicar or Home policy.
1.2. A customer is defined as a main policy holder, excluding joint policy holders or named drivers.
1.3. The competition is only open to Customers who reside in England, Scotland and Wales aged 18 or over, excluding employees of esure Services Ltd, their families, its affiliated companies, distributors, agents and anyone professionally connected with the administration of the competition.
1.4 Internet access and a Facebook account are required. Private profiles that enter cannot be seen therefore cannot be accepted.

2. When to Enter
2.1. The competition will open from 13 September 2018 and close at 23.59 on 12 October 2018.

3. How to Enter
3.1. In order to enter the competition, eligible participants must like the esure Facebook page and comment on the relevant competition post on the esure Facebook page with the correct number of seagulls in the 360 degree picture. 
3.2. A maximum of one entry per eligible customer is permitted. Entries on behalf of another person will not be accepted and joint submissions are not allowed. 
3.3. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted.  If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the competition in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.
3.4. The Promoter (see clause 10 of these Terms and Conditions) reserves the right at its absolute discretion to disqualify entries which it considers do not comply with these terms and conditions or any participant who it reasonably believes has interfered with the fair running of this competition.
3.5. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of a participant.
3.6 The Promoter shall have the right to review all entry posts on the esure Facebook page  and  if a post could in any way be regarded as being disrespectful towards other Facebook members  or community, or which contain anything which is likely to, or could cause offence or distress  it will be removed from this competition. 

4. Prizes
4.1. The prizes for winning the competition will be one of four £250 Overnight Luxury Spa for two vouchers from Virgin Experience Days for the first four eligible entrants selected.   Travel to and from the spa will not be included in the prize and this is the responsibility of the winners to organise. The Voucher does not include gratuities, meals or other travel expenses unless otherwise stated, or any other costs of a personal nature not stated.
4.2. Winners may opt to receive the cash equivalent (Cheque) of the value of the Voucher. To opt for the cash equivalent, the winners shall inform the Promoter of this option when they are confirming their contact and policy details (see point 4.4).

4.4. There will be four winners who will be selected within 5 working days of the closing date of the competition.
4.5. The winners will be contacted within 14 days of the competition closing. The Promoter will attempt up to four contacts over 14 days to ask for each winner’s full name, policy number, email address, county and postal address to send the prize to.  Together with personal details for contact, the winner shall also clarify if they would like to receive the cash equivalent of the prize (Cheque) instead of the vouchers.  You must provide accurate contact details on notification of winning. If you do not respond with this information within 14 days of the Promoter first contacting you, then you will no longer be eligible for the prize.  If winners are no longer eligible, new winners will be selected from a list of reserves drawn at the original time.
4.6. The Vouchers or cash equivalent (Cheque) will be despatched by recorded delivery post within 14 working days of the winners confirming their contact details.
4.7. The vouchers are as stated and they cannot be sold or exchanged for cash or goods. 
4.8. By entering the competition, entrants accept these terms and conditions and agree to be bound by them.

5. Data Protection and Publicity
5.1. By entering this competition you consent to the Promoter and its agents’ collection, retention, usage and distribution of your personal information in order to process, contact you about your prize and/or deliver the prize to you. 
5.2. Any personal data relating to participants will be used solely in accordance with current UK data protection legislation. By entering the competition, you agree that the Promoter and/or its agents may contact you in relation to the competition, including: 
5.2.1 Promote/announce all winners on our social media channels (Facebook, Twitter) by using customer name and if possible tagging in to customer social media profiles
5.2.2 Request testimonial comments from winners for us to use in marketing
5.3. The Promoter will process entrant’s personal data in accordance with its Privacy Notice: https://www.esure.com/privacy   

6. Competition Rules
6.1. The competition winners (chosen from eligible entries who would have correctly answered the question) will be randomly selected by a computerised randomiser.
6.2. The last name, initials and county of each winner will be available on request to those sending a stamped, addressed envelope to September Edition Newsletter Competition, Marketing, esure, The Observatory, Castlefield Road, Reigate, Surrey, RH2 0SG, within 3 months of the closing date.
6.3. We reserve the right to change the competition rules and these terms and conditions from time to time. If we do so, we will always have the most up to date terms and conditions on the Website and in the case of a discrepancy between these terms and conditions and those on the Website, the Website terms and conditions will apply. Your continued use of the website will constitute your acceptance of the new rules and/or Terms and Conditions.

7. Promotion
7.1. This promotion is in no way sponsored, endorsed or administered by, or associated with, Virgin Experience Days, Facebook or any other social network. By entering the promotion, all participants accept that they have no claim against Facebook. By entering the promotion, all participants agree to a complete liability release for Facebook. 

8. Liability and Indemnities
8.1. The Promoter will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. 
8.2 The Promoter is not responsible for the acts or default of third party suppliers, but will endeavour to resolve any issues that may arise.

9. Jurisdiction
9.1. The competition and these terms and conditions are governed by English Law. England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions.

10. The Promoter

11. Entire Agreement
11.1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
