“Guess the missing words from the Christmas songs” Competition Terms and Conditions

1. Who can Enter
1.1. To be eligible to enter the competition entrants will need to be an esure customer with an existing esure Motor, Multicar, Home or Travel policy.
1.2. A customer is defined as a main policy holder, excluding joint policy holders or named drivers. The customer must also be of the appropriate age to be a policyholder.
1.3. The competition is only open to customers who reside in England, Scotland and Wales, excluding employees of esure Services Ltd, their families, its affiliated companies, distributors, agents and anyone professionally connected with the administration of the competition.
1.4. Internet access is required.

2. When to Enter
2.1. The competition will open from 12.01am 2 December 2019 and closes at 11.59pm on 16 December 2019.

3. How to Enter
3.1. In order to enter the competition, eligible participants must, within the competition time frame under clause 2, send an email to [email protected] with their full name and guess of what the missing lyrics from each of the three Christmas songs featured in the competition video are.
3.2. Entries made via Facebook will not be accepted.
3.3. A maximum of one entry per eligible customer is permitted. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
3.4. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the competition in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.
3.5. The Promoter (see clause 10 of these Terms and Conditions) reserves the right at its absolute discretion to disqualify entries which it considers do not comply with these terms and conditions or any participant who it reasonably believes has interfered with the fair running of this competition.
3.6. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of a participant.
3.7. The Promoter shall have the right to review any additional comments made on the esure Facebook page. If a post could in any way be regarded as being disrespectful towards other Facebook members or community, or which contain anything which is likely to, or could cause offence or distress it will be removed from this competition.

4. Prize
4.1. The prize for winning the competition will be 1 of 10 £100 Amazon.co.uk gift cards.
4.2. The prize is as described, non-negotiable, and non-transferable. The prize cannot be exchanged for cash or any alternative option.

4.4. There will be ten winners in total who will be selected within 5 working days of the closing date of the competition.
4.5. The winners will be contacted within 14 days of the competition closing by email.
4.6. The Promoter will attempt to contact the winners up to four times for each prize winner over a period of 14 days to ask for the winners’ full name, policy number, email address, county and postal address to send the prize to. The winners must provide accurate contact details on notification of winning. If any winner does not respond with this information within 14 days of the Promoter first contacting them, then they will no longer be eligible for the prize. If any winner is no longer eligible, a new winner will be selected from a list of reserves drawn at the original time.
4.7. The prize will be despatched by recorded delivery within 28 days of each winner confirming their contact details.
4.8. By entering the competition, entrants accept these terms and conditions and agree to be bound by them.

5. Data Protection and Publicity
5.1. By entering this competition participants consent to the Promoter and its agents’ collection, retention, usage and distribution of their personal information in order to process such personal information, contact the winners about their prize and/or deliver the prize to them.
5.2. Any personal data relating to participants will be used solely in accordance with current UK data protection legislation. The Promoter shall seek consent from the winners in order to do the following:
5.2.1. promote/announce the winners on our social media channels (Facebook, Twitter) by using customer name and if possible tagging in to customer social media profiles; and/or
5.2.2. in accordance with clause 6.2, provide details of the winners to those who request it; and/or
5.2.3. request testimonial comments from the winners for the Promoter to use for marketing purposes.
5.3. The Promoter will process entrant’s personal data in accordance with its Privacy Notice: https://www.esure.com/privacy.

6. Competition Rules
6.1. The competition winners (who will be chosen from eligible entries who guessed correctly) will be randomly selected by a computerised randomiser.
6.2. Subject to clause 5.2.2, the last name and county of the winners will be available on request to those sending a stamped, addressed envelope to Christmas Edition Newsletter Competition, Marketing, esure, The Observatory, Castlefield Road, Reigate, Surrey, RH2 0SG, within 3 months of the closing date.
6.3. The Promoter reserves the right to change the competition rules and these terms and conditions from time to time. The Promoter will always have the most up to date terms and conditions on its website and in the case of a discrepancy between these terms and conditions and those on the website, the website terms and conditions will apply. Continued use of the website will constitute acceptance of the new rules and/or Terms and Conditions.

7. Promotion
7.1. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or any other social network. By entering the promotion, all participants accept that they have no claim against Facebook and agree to a complete liability release for Facebook.

8. Liability and Indemnities
8.1. The Promoter will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
8.2. The Promoter shall not be liable or responsible for any expenses incurred by the winners over and above the prize offered.
8.3. The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise.

9. Jurisdiction
9.1. The competition and these terms and conditions are governed by English Law. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions.

10. The Promoter
10.1. The Promoter is esure Services Limited, who are a company registered in England and Wales (number 02135610) whose registered office address is at The Observatory, Reigate, Surrey RH2 0SG, and who are authorised and regulated by the Financial Conduct Authority (number 312063).
10.2. The insurance is underwritten by esure Insurance Limited who are authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority, number 203350.

11. Entire Agreement
11.1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
