“Tell us what you were doing 20 years ago” Prize Draw Terms and Conditions
1. Who can Enter
1.1. To be eligible to enter the prize draw participants will need to be aged 18 or over and have an active Facebook account.
1.2. The prize draw is only open to participants who reside in England, Scotland and Wales, excluding employees of the Promoter (see clause 10 of these Terms and Conditions), their families, its affiliated companies, distributors, agents and anyone professionally connected with the administration of the prize draw.
1.3. Internet access is required to enter.
1.4. By entering the prize draw, participants accept these terms and conditions and agree to be bound by them.
2. When to Enter
2.1. The prize draw will be open from 00.01 on 17 February 2020 and will close at 20:20 on 20 February 2020.
3. How to Enter
3.1. In order to enter the prize draw, eligible participants must, within the prize draw time frame under clause 2, comment on the associated Facebook post comment telling us what they were doing 20 years ago.
3.2. A maximum of one entry per eligible participant is permitted. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
3.3. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the prize draw in a way that is not consistent with the spirit of the prize draw, that person’s entries will be disqualified and any prize award will be void.
3.4. The Promoter reserves the right at its absolute discretion to disqualify entries which it considers do not comply with these terms and conditions or any participant who it reasonably believes has interfered with the fair running of this prize draw.
3.5. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid entries including, without limitation, to require further verification as to the identity, age, and other relevant details of a participant.
3.6. The Promoter shall have the right to review the comments made on the esure Facebook page. If a comment could in any way be regarded as being disrespectful towards others or contains anything which is likely to cause offence or distress, it will be removed and the entry will not be valid.
4. Prize
4.1. The prize for winning the prize draw will be 1 of 20 cheques to the value of £20.
4.2. The prize is as described, non-negotiable, and non-transferable. The prize cannot be exchanged for any alternative option.
4.3. There will be 20 winners in total who will be selected within 5 working days of the closing date of the prize draw.
4.4. The winners will be contacted via Facebook messenger within 14 days of the prize draw closing.
4.5. The Promoter will attempt to contact each winner up to four times over a period of 14 days to ask for the winners’ full name, email address, county and postal address to send the prize to. The winners must provide accurate contact details on notification of winning. If any winner does not respond with this information within 14 days of the Promoter first contacting them, they will no longer be eligible for the prize. If any winner is no longer eligible, a new winner will be selected from a list of reserves drawn at the original time.
4.6. The prize will be despatched by recorded delivery within 28 days of each winner confirming their contact details.
5. Data Protection and Publicity
5.1. By entering this prize draw participants consent to the Promoter and its agents’ collection, retention, usage and distribution of their personal information in order to process such personal information, contact the winners about their prize and/or deliver the prize to them.
5.2. Any personal data relating to participants will be used solely in accordance with current UK data protection legislation. The Promoter shall seek consent from the winners in order to do the following:
5.2.1. promote/announce the winners on our social media channels (Facebook, Twitter) by using the winners’ names and if possible tagging in the winners’ social media profiles; and/or
5.2.2. in accordance with clause 6.2, provide details of the winners to those who request it; and/or
5.2.3. request testimonial comments from the winners for the Promoter to use for marketing purposes.
5.3. The Promoter will process participant’s personal data in accordance with its Privacy Notice: https://www.esure.com/privacy.
6. Selecting Winners and Amending these Terms and Conditions
6.1. The prize draw winners (who will be chosen from eligible entries who answered correctly) will be randomly selected by a computerised randomiser.
6.2. Subject to clause 5.2.2, the last name and county of the winners will be available on request to those sending a stamped, addressed envelope to 20 Years Ago Social Prize Draw, Marketing, esure, The Observatory, Castlefield Road, Reigate, Surrey, RH2 0SG, within 3 months of the closing date.
6.3. The Promoter reserves the right, where necessary in order to continue the availability of this prize draw, to change the prize draw rules and these terms and conditions. The Promoter will always have the most up to date terms and conditions on its website and in the case of a discrepancy between these terms and conditions and those on the website, the website terms and conditions will apply.
7. Promotion
7.1. This prize draw is in no way sponsored, endorsed or administered by, or associated with, Facebook or any other social network. By entering the prize draw, all participants accept that they have no claim against Facebook and agree to a complete liability release for Facebook.
8. Liability and Indemnities
8.1. The Promoter will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this prize draw or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
8.2. The Promoter shall not be liable or responsible for any expenses incurred by the winners in relation to this prize draw.
8.3. The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise.
9. Jurisdiction
9.1. The prize draw and these terms and conditions are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions.
10. The Promoter
10.1. The Promoter is esure Services Limited, who are a company registered in England and Wales (company number 02135610) whose registered office address is at The Observatory, Reigate, Surrey RH2 0SG, and who are authorised and regulated by the Financial Conduct Authority (reference number 312063). The Promoter is part of esure Group plc.

11. Agreement
11.1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
