esure June 2022 Facebook prize competition – ”Win a Shaun the Sheep” Competition Terms and Conditions


1. Who can Enter
1.1. To be eligible to enter the competition participants will need to be aged 18 or over and have an active Facebook account.
1.2. The competition is only open to participants who reside in England, Scotland and Wales, excluding employees of the Promoter (see clause 11 of these Terms and Conditions), their families, its affiliated companies, distributors, agents and anyone professionally connected with the administration of the competition.
1.3. Internet access is required to enter.
1.4. By entering the competition, participants accept these terms and conditions and agree to be bound by them.

2. When to Enter
2.1. The competition opens 08.00 on 22 June 2022 and will close at 23:59 on 01 July 2022.

3. How to Enter
3.1. In order to enter the competition, eligible participants must, within the competition time frame under clause 2, comment on the associated Facebook post telling us the missing word from Brake’s campaign objective: Every child has the right to make xxxx and healthy journeys.
3.2. A maximum of one entry per eligible person is permitted. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Multiple entries from the same person via duplicate Facebook accounts is not permitted.
3.3. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified from the competition and will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the competition in a way that is not consistent with the spirit of the competition, that person’s entries will be disqualified from the competition and any prize won will be void.
3.4. The Promoter reserves the right at its absolute discretion to disqualify entries from the competition which it considers do not comply with these terms and conditions or any participant who it reasonably believes has interfered with the fair running of this competition.
3.5. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid entries including, without limitation, to require further verification as to the identity, age, and other relevant details of a participant.
3.6. The Promoter shall have the right to review the comments made on the esure Facebook page. If a comment could in any way be regarded as being disrespectful towards others or contains anything which is likely to cause offence or distress, it will be removed and the entry to the competition will not be valid.

4. Prize
4.1. The prize for winning the competition is one 8” Black and White Shaun the Sheep toy
4.2. The prize is as described, non-negotiable, and non-transferable. The prize cannot be exchanged for any cash or alternative option.
4.3. There will be 1 winner in total, who will be selected within 5 working days of the closing date of the competition.
4.4. The winner will be contacted via Facebook messenger within 14 days of the competition closing.
4.5. The Promoter will attempt to contact the winner up to four times by Facebook messenger over a period of 14 days to ask for the winner’s full name, email address, date of birth and full postal address. The winner must provide accurate details on notification of winning. If the winner does not respond with this information within 14 days of the Promoter first contacting them, they will no longer be eligible for the prize. If a winner is no longer eligible, a new winner will be selected from a list of reserves drawn at the original time.
4.6. The Shaun the Sheep toy will be sent by Royal Mail Special Delivery within 28 days of the winner confirming their details.

5. Data Protection and Publicity
5.1. By entering this competition participants consent to the Promoter and its agents’ collection, retention, usage and distribution of their personal information in order to process such personal information, contact the winner about their prize and/or deliver the prize to them.
5.2. Any personal data relating to participants will be used solely in accordance with current UK data protection legislation. The Promoter shall seek consent from the winner in order to do the following:
5.2.1. promote/announce the winner on our social media channels (Facebook, Twitter) by using the winner’s name and if possible tagging in the winner’s social media profile; and/or
5.2.2. in accordance with clause 6.2, provide details of the winner to those who request it; and/or
5.2.3. request testimonial comments from the winner for the Promoter to use for marketing purposes.

6. Selecting Winners
6.1. The competition winner (who will be chosen from eligible entries who answered correctly) will be randomly selected by a computerised randomiser.
6.2. Subject to clause 5.2.2, the last name and county of the winner will be available on request to those sending an email requesting this to [email protected] with ‘esure June 2022 social competition winners’ in the subject line, within 3 months of the closing date.

7. Amending these Terms and Conditions
7.1. The Promoter reserves the right, where necessary in order to continue the availability of this competition, to change the competition rules and these terms and conditions. The Promoter will always have the most up to date terms and conditions on its website and in the case of a discrepancy between these terms and conditions and those on the website, the website terms and conditions will apply.

8. Promotion
8.1. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or any other social network. By entering the competition, all participants accept that they have no claim against Facebook and agree to a complete liability release for Facebook.

9. Liability
9.1. The Promoter will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
9.2. The Promoter shall not be liable or responsible for any expenses incurred by the winner in relation to this competition.
9.3. The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise.

10. Jurisdiction
10.1. The competition and these terms and conditions are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions.

11. The Promoter
11.1. The Promoter is esure Services Limited, which is a company registered in England and Wales (company number 02135610). Its registered office address is at The Observatory, Reigate, Surrey RH2 0SG. It is authorised and regulated by the Financial Conduct Authority (reference number 312063). esure is a brand of the Promoter. The Promoter is part of esure Group plc.

12. Agreement
12.1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
